Terms of Service
These terms form the agreement between you and [Registered legal entity name] for use of OwnMark Write. By creating an account you accept them.

1. Accounts
Accounts are opened by an adult parent, guardian or authorised school staff member, who is responsible for all activity under the account and for the child profiles created within it. The number of child profiles is set by your plan. Keep your password confidential and tell us promptly if you suspect unauthorised access.
2. What the service is
OwnMark Write is a Socratic writing-practice tool. The tutor deliberately does not write, rewrite or complete student work. Feedback and scores are indicative practice guidance aligned to Australian Curriculum descriptors — they are not official marks, and they do not predict NAPLAN, school report or ATAR outcomes.
3. AI limitations
Feedback is generated in part by large language models. Despite evidence checks, rubric anchoring and human-reviewable logs, output may contain errors. Always apply your own judgement and your school's guidance. Do not rely on the service as the sole basis for academic decisions.
4. Acceptable use
Use of the service is subject to the Acceptable Use Policy. We may suspend accounts that breach it.
5. Academic integrity
The service is designed to support original student work and keeps a process record of how a draft developed. You must not use it to produce work presented as someone else's, or in a way that breaches your school's assessment rules.
6. Subscriptions, credits and cancellation
- Plans are billed in advance on a recurring basis until cancelled, and include a monthly allowance of AI usage credits.
- You can cancel at any time from Settings; access continues to the end of the paid period.
- Prices are in Australian dollars and include GST where applicable. We will give at least 30 days' notice of a price change.
- Unused credits do not carry over between billing periods unless stated on your plan.

7. Your content
Students and their families own the drafts they write. You grant us a limited licence to store and process that content solely to operate the service (including sending it to AI providers to generate feedback). We do not claim ownership and do not use identifiable student writing for marketing.
8. Our content
The software, prompts, rubric registry, exemplar commentary and branding are our intellectual property or that of our licensors. Curriculum materials remain the property of the relevant authority (ACARA, NESA, VCAA, QCAA, SACE and others) and are used for educational reference only. We are not affiliated with or endorsed by those authorities.
9. Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For a major failure you are entitled to a replacement or refund and to compensation for any other reasonably foreseeable loss or damage. Nothing in these terms limits those rights. Subject to that, our liability is limited to resupplying the service or refunding the amount you paid in the previous 12 months.
10. Suspension and termination
We may suspend or close an account for non-payment, serious or repeated breach of these terms, or where required to protect a child's safety. You can close your account at any time.
11. Changes and governing law
We may update these terms and will notify you of material changes before they take effect. These terms are governed by the laws of the state or territory in which we are registered, and the courts there have non-exclusive jurisdiction. Questions: support@ownmark.com.au.
